Hue - Landis Testifies

Landis testifies and is examined by Jacobs. The still photographers are going crazy with snapping their photos.

I'll check in on the legal stuff.

Didn't using any PED's with Phonak but had a TUE for his hip.

Had a prescription for thyroid deficiency. Said it's a little blue pill "does that help?" Campbell; "Not for me."

Stage 16, he didn't eat or drink enough and like a car, he ran out of gas. He didn't feel well from the beginning. He lost focus. He "bonked" going up the last hill. Last climb 8 to 10 miles up and he lost 8 mins to the winner and dropped from 1st to 11th.

He wanted to get away from the cameras. He had to get motivated but he laid down and ate food first. He took a hot shower-he was cold.

he talked to the press, had dinner across the parking lot. Sat with Axel Merxx and Robbie hunter, drank Jack Daniels and made a plan

Needed to get his time on the next day and in the time trial. he figured if he went tradfitional and attck the last climb and do well in the TT, he would get 3 mins-not enough. So let's surprise them and try to get away the next day. He figured he could do that. He would have taken any one from the top 10 with him.

He took off on the first climb like he would have on the last climb. He didn't use testosterone or banned substances the night of Stage 16.

First hour of Stage 16, there was a brak away and they guys weren't a threat. At the first climb they ramped it up using the team to split the peloton. They couldn't talk to wortk out a plan when they split apart. He then did a 4 hour time trial.

The other guys' team's miscalculated and didn't get him. They allowed him 9 mins but got 2 back on a 5 miles flat before the last climb. They didn't move fast enough and he won by 5 mins, moving to 2nd or 3rd, 1.5 mins back of the yellow jersey.

He didn't win the TT but he got the yellow. At the end he was tired. Didn't use PED's or testorone during or after the TDF

he found out from a Team Director that he had tested positive July 26th. he didn't know how it happened. He knew it was a disaster once it went public. He thought it was a TUE. talked to his wife and told her that is what he thought. no place to hide but later that afternnon he found it wasn't the TUE

Lelangue talked to Jean Marie, it was out that it was a top 10 finisher. press called all Federations, only US Federation didn't deny so it was him by deduction.

he met with Spanish lawyers and issued a statement. He said he had naturally high testosterone produced by his own "organism". He regretted saying that. He got no help from anyone nad relied on the lawyers, who aren't with him today.

Cortizone injections, Jack Daniels stuff he mentioned but he didn't know. he read about his "B" test on the internet through a UCI statement and he was fired.

TBV is up briefly, but loses the thread again.

He wrote the internet post about Lemond. He appologized.

About Will, Landis was in a hotel banquet hall. He told people about Lemond's childhood to prep for Lemond's testimony. He heard Will's call but didn't know he was making it. He didn't tell Will to do it and Lemond called back -Will didn't answer. Landis left and so did Will.

Will was his manager since August. He went to Will's room. He was visibly disturbed. Landis confirmed what happened and Landis told the lawyers the next day.

They fired Will and Landis helped him move his stuff out of the hotel and hasn't seen him since.

He wants to return to cycling. his hip is fine.

He read Dick Pound's statements and Pat McQuaid's.

his wife was offended by Pounds 100's of virgins comments.

his reputation has been effected.

He says he's not a cheater.

McLaren watches him carefully during his final statement.

Adjourned to Monday.

Landis cross will be later on monday as there are 2 Landis witnesses that must go Monday. USADA may have some witnesses too.

Odd they would wait until Monday after 3 witnesses to do cross? Interesting.

Keep pulling . This is just absurd .Floyd really needs to get his case public in real time . He is hanging on by the scruff of his neck after the Lemond event .This is a major problem for them now and they cant fix it.With just a few arguements in his favor , he regains the public opinion and wins back his FFF supporters . This is irreversable!

With respect to Catlin's testimony is it actually legal to withhold evidence that might exonerate an athlete that is being suspended? I understand an athlete signs something in order to compete but as a citizen of this country do the laws offer any protection?

There is no obligation in arbitration to give exculpatory evidence.

Nothing like a few Jack Daniels to help you recover from a major bonk in a three week stage race. I'm sure that most top pro's do this, but im guessing that the majority prefer Southern Comfort for major rehydration purposes.

I was there . I saw Floyd crack on the Mollard . He then sat on and then really blew on the third k on La Toussiure . That was my hottest day outdoors ever . The next day he out foxed em . Period . If he was doped he would of dropped Sinkawitz way earlier. They came back and got within 5 min of him . He simply turned his way up the Joux in a controlled manner and then put a min on everyone on the descent! Just a great effort !

thank you for all your great work! your colour has added a wonderful touch of "you are there" for those of us that were stuck only reading. even when i was able to get in, i still went back to the posts. just wonderful stuff. a joy to read. and very enlightening on the legal shenanigans (i will think of you every time i see a pretty monkey).

TUE = Theraputic Use Exemption. It's permission to use a banned substance for medical reasons.

LeMond vs. Floyd, who is telling the truth?
Well, it shouldn't be too hard for a reporter to find out if Greg is writing a book about his childhood trauma. If that's true, then it is a pretty essential part of the phone conversation omitted by Greg and lends support to Floyd's version.

I'm not sure if you can ever tell if anyone's doping - or not - from a result, really. Joe Papp doped and remained a marginal pro at best, right?

I saw every stage of the Tour de Toona where Gen Jeanson tested positive (EPO). She won GC, but no individual stage. Hardly a dominating performance.

She settled with USADA rather than go to arbitration and it seemed USADA had something to hide. Despite being her second offense (technically, a missed test; there had been a medical DQ for high hematocrit in another race considered suspicious but not technically a positive), she only got two years which was almost up by the time she settled, and she didn't have to acknowledge that she doped on the settlement. She had presented a study done by a Belgian professor which purported to show (based on tests she did) that her body produced a false positive:

Conclusion: she really didn't have the money to fight all the way but USADA and WADA would look bad if she had ,well, done what Floyd's doing and put some lab techs on the stand and see how much they really know about what they're doing.

Thank-you for sharing your observations on this arbitration case. Your comments were a pleasure to read. I went back and viewed some of the hearing archives after reading the nuances you observed and was able to appreciate what I saw more. It was like watching movies with the director’s commentaries on.

Interesting summary on the Fox sports site. It's unbelieveable Landis actually said something like "I didn't dope, because it wouldn't serve any purpose." How about winning the tdf and all the money that comes with it; isn't that enough of a purpose? The gist of the article seems to be Landis denied doping, is hurt he's been accused of it, and his mom believes he didn't dope. Also, something to the effect from his mom that Landis would never dope because he's a good Christian, and Landis also testified about his religous upbringing.

If there is no "law" that can force exculpatory evidence in arbitration, such as this, then there can be no "legal" basis for the manager to face charges of tampering/obstruction...right?

I apologize for a long post. Today was my first visit to the Proceedings. I sat in the overflow room with 6 others. Arriving after work, I only got to see Floyd and Jacobs on the huge-screen monitor.

Dilemma: Floyd, either you are one of the great pathological liars of our time (on par with OJ, IMHO), …or you are so transparent, straight-talking, and humble that every word you say is your understanding of the truth. I choose to believe the latter. Here’s why.

Floyd was ever so modest about his early victories, and the intense & loooong training it took. Jacobs asked about the MTB racing & then road racing, each season, and some big races in particular. Each time he had to follow up, “And how did you do?” “I won.” Maybe half a dozen times. No self glorification.

Everything was a simple story, including the Jack Daniels, and the statement he read to reporters while in Spain very shortly after the disclosure (it was hastily written by lawyers; Floyd had never read it until read it to reporters). Floyd wears his “heart on his sleeve.” In spite of Lemond acting like a spoiled brat (repeatedly; remember, he came to town to screw Floyd), FL seemed genuinely to want to treat him with a higher level of respect that was warranted. Did you know that Greg L. is writing a book, (according to FL)? Do you think that the “admission” will show up in it? (“I did NOT say I doped, because I didn’t dope.”) FL said that GL did not regard the abuse he suffered to be a secret, but FL refused to even utter the words child abuse. I think it was too traumatic to FL (!!) to say the words.

He wouldn’t even say some of the “Dick” Pound comments; Jacobs had to say them and ask what FL thought. FL was embarrassed. Humility, which seemed to come from deep inside instead of saying the right thing to please Mom & Dad (her presence on the screen was one of total serenity).

This is one simple guy. You could tell every emotion. You can imagine anger and unwise actions & words, even as he calmly described an event. I don’t think he doped. GL was right about one thing: holding in a doping secret would have killed Floyd by now. But, then to screw family and friends is unimaginable if you watch his emotions.

I’ve read everything I can on TBV & DPF. I don’t think I’m pollyann-ish (I’m a cynical old fart), but Floyd is a simple & honest guy. I found no BS, and I was looking for the slightest trace of that. He’s no liar. He’s no doper. I wish you had seen it.

Hey rocket,
That is why in a "real" trial, you have to see the testimony for yourself and that is why we have testimony in front of us and not on the telephone, usually, to test and assess credibility.

But this hearing is not about whether he doped. He is assumed to have done so by the adverse analytical findings on both his "A" and "B" samples. He must prove the lab violated International Standards. If so, USADA must prove the violations did not "cause" the adverse analytical finding.

to the person who asked about whether "witness tampering" was a possibility in an arbitrational panel circumstance. the short answer is likely "yes" for the reasons set forth in the article i cited at the beginning of the day. Scroll back to find it.
