Hearing - Final Sign Off

That's over, and after the drive up I5, back home. Summaries, analysis etc. will follow, perhaps not until the weekend. We're a little burned out. Roundups will continue, probably at the normal rate.

I have pictures of slides from Young and Suh's closing, but it's kind of a hassle to upload, so that will wait.

One question to ponder: If USADA was worried about Landis "tampering" with data files, now that they know about "save method" in the software, is there a reason not to give him a copy now? They could always run a "method" he provided against their own known-good data if there was any question.

[UPDATE:] USADA has refused to let Landis have his actual data. It has remained in the posession of Dr Botre. Davis was only allowed "remote control" access during the reprocessing at LNDD. Young attempted to argue that was "good enough"

Thanks for the amazing coverage. It's been really interesting. I was a big Tyler fan, couldn't believe he doped, but after a lot became pretty convinced. I came into this hoping Floyd was clean. After all this, still don't know, but I blame the testing agencies for screwing up big time. I wouldn't have known the story without the work here.

Yep, thanks for the lengthy and fantastic output on the case! Any predictions from the TBV panel on the outcome based on closing testimony? I'm thinking 2-1 against Floyd.

Thank you all very much for providing such good reportage and insight into the case - it's been compelling reading. Starting from an open-minded position, I think that any finding against Landis would be unsafe... but only Floyd knows whether he actually doped (I wouldn't want to guess)! I hope that the right result comes out, for the sake of cycling, but I fear that whichever way it goes, there will be a large number of doubters, and that effectively Floyd will ultimately lose, even if he wins.

.... but I really do hope this forces the science to become more regulated, as the efforts from LNDD (maybe the "Mal", French for "bad" and "lab" in "Malabry" are prescient!) are evidently fundamentally flawed, and they should be either fully audited, or closed down until they can prove that they care about finding the truth rather than creating a result.

Anon 12.31. Good call about 'mal' and 'lab'. The real derivation is good, too. Malabry is derived from 'spoiled ground'. I mentioned this in the Floyd petition launched last August.

This petition has had 3500+ sigs - including from the Tyler Hamilton camp - and said way back then that this case possibly revolved not on Nazi frogmen but "rogue technicians."

As we have all seen, the technicians may not be "rogues", just poorly trained and not really up to the important job entrusted to them.

Did the Landis team have the electronic data files? In the opening days of the hearing I thought I heard they had received them on the 5th of May. I was surprised the Davis demo did not use them. Do you have a clarification?

BTW, We just published a follow up to our post "When science, peer review & independent experts are anything but" our latest post is titled "LNDD: The Chain of Custody was broken". It is written by Roberta Barbalace, our environmental technical editor, who is intimately familiar with COC and the absolute necessity that drug testing procedures be 100% reliable and reproducible.

The issue of LNDD's procedures go way beyond athletes. It affects normal people who, due to the nature of their jobs, must be routinely drug tested and must be able to have confidence that those procedures are handled correctly. Simply put, LNDD needs to be shut down entirely not just have their WADA accreditation stripped from them.

I deeply appreciate the whole TBV team. You've provided insightful and reasonably objective coverage of this process.
TBV's reportage is without peer in this manner and it seems to me that the best of the second tier coverage owes a great deal to TBV. You have met your Groklaw ideal.

Thank you so much, TBV, for bringing cycling fans around the world into the courtroom. I never watched the video feed; I simply read your blog in between meetings and felt like I was right there.

Floyd's insistence on a public arbitration allowed TBV and other media into the room. That allowed all of us to see how truly sloppy (or worse) LNDD’s work is, and how our tax dollars are being used by USADA to support an anti-doping scheme that is quite simply not defensible.

We all want doping out of sports. And I think we’ll never really know if Floyd doped or not. I think we can all agree that this lab’s results should not be the basis for destroying any athlete’s career.

Let’s insist that the USADA get it right. Especially for all the lower-paid athletes who don't have the money to put up a fight.
